1. Acceptance of Terms

This website and the services offered on it are provided by SEO Faction, LLC (hereinafter referred to as "SEO Faction") as a service to you, subject to the following Terms of Service (hereinafter referred to as the "Terms of Service"). Your use of PressDr.com and the Service, as defined below, constitutes your unconditional agreement to follow and be bound by these terms. In addition, the Terms of Service may be updated by us from time to time without prior notice to you. Your continued use of PressDr.com and the Service, as defined below, following any changes to the Terms of Service constitutes your acceptance of the Terms of Service as changed. As such, we encourage you to review these terms from time to time.
In consideration of your use of the service, you agree to provide valid registration and contact information. If you're contact information is incorrect, SEO Faction has the right to terminate your account and refuse any use of the service.
By accepting these Terms of Service through your use of the service, as defined below, you certify that you are at least 18 years of age.
2. Description of Service
In this Terms of Service, "the service" shall mean the company SEO Faction, LLC, the website PressDr.com and any information found on the website and any communication, electronic or otherwise on, by, or through the website or SEO Faction, LLC (hereinafter collectively referred to as the "Service").
You also understand and agree that the service may include advertisements and that these advertisements are necessary for SEO Faction to provide the service and that these advertisements may come from a third party. You agree not to hold SEO Faction liable for the content of any advertising.
The service may include other information as found on PressDr.com, as communicated via email, through RSS Feeds, or other electronic communication. Regardless of the source of information, the the service shall be subject to these Terms of Service.
3. RSS Feeds and Online Distribution
Also part of the service is SEO Faction's RSS (really simple syndication) service, which is a means by which SEO Faction offers feeds of press releases and other information information in XML format ("RSS Content") to users of SEO Faction who use RSS aggregators or to who display the headlines in the RSS feeds on their websites. The RSS service may be used only with those platforms from which a functional link is made available that, when accessed, takes the viewer directly to the display of the full article on the SEO Faction website. You may not display the RSS Content in any way that does not link to the appropriate SEO Faction Site or PressDr.com web page. SEO Faction retains all ownership to the RSS Content and to any and all SEO Faction logos and trademarks used in connection with the RSS service. You must provide attribution to PressDr.com in connection with your use of the RSS feeds. SEO Faction reserves the right to discontinue providing any or all of the RSS feeds at any time and to require you to cease displaying, distributing or otherwise using any or all of the RSS feeds for any reason including, without limitation, your violation of any provision of these Terms of Service. SEO Faction assumes no liability for any of your activities in connection with the RSS feeds or for your use of the RSS feeds in connection with your website.
4. Email and Fax Distribution
As part of the service is SEO Faction's email distribution service, which is a means by which SEO Faction offers press releases and and various information to journalists, reporters, news editors, other individuals, and users of SEO Faction. This service includes the distribution of user information along with users press releases to outside sources. SEO Faction is not responsible for the use, redistribution, or publication of this information by any outside source and assumes no liability for such use. SEO Faction reserves the right to discontinue providing the Email Distribution services at any time for any reason including, without limitation, your violation of any provision of these Terms of Service. In addition you understand that technical processing and transmission of the service, including your Content or any other Content, may involve transmissions over other networks and services and may change to conform to technical requirements of these networks or services.
5. Ownership of Content
SEO Faction does not claim ownership over any content you submit. But by submitting your content to SEO Faction, you grant SEO Faction a royalty free, perpetual license to use, distribute, reproduce, and publish the content and right to incorporate such Content into other works in any format or medium now known or later developed under the same license terms.
6. Proper Use of Service
You agree to use the service only for its intended purposes.
You must agree to comply with all applicable laws for your jurisdiction.
In addition may not use the service for any of the following purposes.
- To post or distribute content that is is threatening, defamatory, or unlawful.
- To misrepresent your identity, including posing as another person or entity.
- To harass a minor for any purpose, in accordance to and as defined by Missouri law.
- To misrepresent your affiliation with any person or entity.
- To post or distribute any advertising material, except in the form of a press release.
- To post or distribute any content that you do not have the right to make available.
- To infringe upon the copyright, patent, or trademark of any person or entity.
- To violate any local, state, or national law or regulations having the force of law.
You understand that all data and information (hereinafter referred to as "content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which the content originated. This means that you, and not SEO Faction, are entirely responsible for the content that you upload or distribute through the service. SEO Faction does not guarantee the accuracy of such content, and suggests you contact the originator of the content for verification. You may not use SEO Faction to publish or distribute content that is inaccurate or offensive in nature. SEO Faction will not be liable in any way for any content, or damage of any kind incurred as a result of the content, made available via the service.
8. Member Account, Password and Security
Upon registration you'll receive a user name and password. Keep it confidential, because you are responsible for any activities that occur under your user name or password and agree to notify SEO Faction if you suspect any unauthorized use of your account. After each session you should sign out of your account.
9. Right to Delete Content or Accounts
You acknowledge that SEO Faction may remove any Content that is available via the service. Without limiting the foregoing, SEO Faction and its designees shall have the right, but is under no obligation, to remove any Content that violates the Terms of Service or is otherwise objectionable. However, you agree that SEO Faction has no responsibility or liability for the deletion or failure to store any communications or Content
SEO Faction may suspend, close, or delete any user account for a violation of the Terms of Service. In addition you consent and agree that SEO Faction may access and preserve your account information, even if your account is closed, in order to comply with government regulations or to respond to such inquiries, but is under no obligation to do any of the aforementioned.
If your account or any of your content is deleted for violating the Terms of Service SEO Faction reserves the right, but is under no obligation, to prevent future access to the service.
SEO Faction reserves the right to close or delete any user account or prevent any users access to the service for any reason, regardless of whether or not the Terms of Service was violated.
10. No Resale of Service
You agree not to resell or exploit for any commercial purposes, any portion of the service or access to the service.
11. Modifications to ServiceSEO Faction reserves the right to modify or discontinue, temporarily or permanently with or without notice. You agree that SEO Faction is not liable for damages caused as a result such modifications to the service.
12. Indemnity
You agree to indemnify and hold SEO Faction, and its subsidiaries, affiliates, and resellers, harmless from any claim or demand, made by any third party resulting from content you post or distribute through the service. In addition you agree to hold SEO Faction and it's officers, agents, and employees harmless for any claim or demand resulting from your use of the service.
13. Third Party Links and Advertising
You understand that SEO Faction is not responsible for the content of third-party advertising contained on it's website or found within any of it's communications and understand that the service may provide, or third parties may provide, links to other websites or resources. You acknowledge and agree that SEO Faction shall not be responsible or liable, for any damage or loss caused or alleged to be caused by third-party advertisers.
14. Copyright Violations
SEO Faction respects the intellectual property of individuals and other entities. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please contact us with the URL of the work you believe violates your copyright and other information required under the Digital Millennium Copyright Act.

16. Legal Jurisdiction
The Terms of Service and the relationship between you and SEO Faction shall be governed by the laws of The Great State of Missouri without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Boone in Missouri.
If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties agree that the other provisions of the Terms of Service remain in full force and effect.
The section titles in the Terms of Service have no legal or contractual effect.
